On 9 June 2010, the Royal Thai Police released a list of names, alleged crimes, and places of detention of those being held under the Emergency Decree. The original list, which can be found here  and which Prachatai reported on , is organized by police unit and alleged crime. Appended below, there is an English-language version of this list. The list appended below has organized this information by the name of each detainee and their place of detention. In the original Thai-language document, the alleged charges and the investigating officer are listed as well. The Thai-language list appears to be a compilation of individual reports, and there are some inconsistencies of the names of places of detention which means that some of the divisions below, namely Bangkok Special Prison and Central Special Prison, may refer to the same location. The Thai-language names of the places of detention have been noted, for purposes of clarity.   

While the release of this information is to be commended, a series of questions remain. Some of these questions are emergent from the list itself, and others from the absences in it.

1. There are 8 youth included in the list. They are currently being detained in juvenile detention centers. How will they be treated under the Emergency Decree?

2. A number of individuals designated as adults are listed as being detained in juvenile detention centers throughout Bangkok and the provinces. Why are they being held in juvenile detention centers, particularly in provinces, such as Chiang Rai, where other detainees are being held in prisons?

3. There are 12 individuals designated as Burmese on the list (2 are in Klong Prem Prison and 10 are in the Central Detention Center in Pathumthani).  How will they be treated under the Emergency Decree?

4. There are 7 individuals who are already being held for two months in the Klong 6 Detention Center in Pathumthani. Under what procedure has their detention been extended to two months?

5. There are 3 individuals who have been sentenced to two years in prison already in the Bangkok Special Prison. Is this sentencing possible under the Emergency Decree? Were they instead prosecuted under the Criminal Code? Either way, why are their names included in a list of detainees being held under the Emergency Decree?

6. In the original Thai-language list, the alleged crimes of the detainees are noted. This ranges from violating curfew to assembling in a group to possessing weapons to arson, in addition to others. What evidence is being used to justify these alleged crimes? 

7. In certain cases, the crime listed itself raises a question. In three of the cases in Ubon Ratchathani, in addition to violating the curfew, being drunk (1 case) or using drugs (2 cases) is mentioned. Given that the use of drugs and alcohol are not mentioned in the Emergency Decree, and given the recent history of the extrajudicial killings during the 2002 alleged “War on Drugs,” this inclusion of these as accusations is concerning.    

8. What about individuals being held by actors other than the police, including the Army and the Border Patrol Police? The name of Mr. Somyot Pruksakasemsuk, being held in Saraburi, is not mentioned in this report. Are there other detainees who have not been mentioned? Are there other sites of detention which have not been reported?
